How *does* one sell a car without a title?

I saw this ad on FB Marketplace for a 2014 CLS in Brooklyn for $15k . Just for the halibut, I pinged the seller and asked how he can sell the car w/o a title. The response was “I’m not even going to answer that. Have a good day.”

I assume there’s a mechanic’s lien and the seller is trying to recoup what they have into it because the owner stiffed them on a repair bill? Even if that’s the case how can they sell a car w/o a title?

I don’t know about modern cars but I could sell you a Model A with a bill of sale and that would work for you to get it on the road.

I’m just taking a wild stab here, but I think if you get a bill of sale, you can use that to apply for a title.  Of course, you’d have to have done your due diligence to make sure that the seller can legally sell you the car.  Otherwise, when you apply for the title, the VIN will pop and the car will come up as stolen or some other horrible situation where you lose all of the money you paid.

This is a stolen car.

If there were in fact a mechanic’s lien on it, there would be steps the mechanic would go through in order to claim an actual title for it.

If it tru ly has a full and legal mechanics lien then the title is now in his name and he can legally sell it with a clean title.  This is sketchy as frig.

Here’s the scheme: Some random hoodstar buys it in cash, drives around with Temp plates for 6-12 months (changing the temp plates for new fake ones every time it’s set to “expire”) then sell it off again to someone else who will do the same. There’s a car near my area that’s had “temp plates” for going on 2 years.

I just assume every car someone’s trying to sell without a title  on CL/FB is stolen. I don’t see why, if you did just lose the title, you wouldn’t apply for a new title (DMV here has a form specifically for lost titles) because it would make it so much easier to sell, and for a lot more money.

Better question is how you buy one.

Sort answer, you don’ t . Normally if its not a parts car or some POS car the family has had forever, its s tolen. That car is hot and would not touch it as you could get arrested or fined for having stolen goods.

Any car that is registered you can go to the DMV and request a new title. If you are the owner that is. I think its filled as a lost title and it takes like a week but you can get a new title.

Long answer to a car that hasnt been registered in a long time or never . For instance l e ts say an old car that you bought out of state but the owner lost the title. There are hoops you have to jump through to get the car register able (i.e. have a title). No matter what you will have to go in front of a judge and it can be at his discretion.   A Bill of S ale that is notified is a great way to start but even then it might not be enough . The key thing to the courts is you have to prove ownership or they can seize it and consider it stolen (even if its not). Then they will sell it at a state auction with a title most likely.

Also dont bring the car to the DMV right away if you dont have a title. It can be taken right there and then, again considered stolen property because you cant prove you own the car.

Also anything 1995 and older doesn’t need a title. Just a bill of sale and you can register it.
